Terms and Conditions

Please read these Terms and Conditions carefully.
This Agreement is between Carlton Whatley and you. For the purpose of these Terms and Conditions, "Carlton Whatley" , "we", "us" or "our" refers to Carlton Whatley and or his qualified agent(s). For the purposes of these Terms and Conditions, "you" or "your" refers to you as a company, corporation, organization or individual. This Agreement governs the terms and conditions of your use of products and services provided by Carlton Whatley - together with any operating rules, policies, subscriptions, agreements, fee schedules, or other supplemental documents, expressly incorporated herein and constitutes the entire agreement between Carlton Whatley and you. This Agreement supersedes any prior agreements between the parties regarding the subject matter of this Agreement.

Changes to the Terms and Conditions
We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. You may or may not be notified of changes. Please check these Terms and Conditions periodically for changes.

You must agree to these Terms and Conditions.
By signing up for, registering or using Products and Services provided by Carlton Whatley, you agree to the Terms and Conditions, and the Privacy Policy. You agree to accept notices via e-mail from Carlton Whatley and you continue to affirm your acceptance of the Terms and Conditions by your continued use of the products and services provided by Carlton Whatley. In order to no longer be bound by these Terms and Conditions, you must discontinue using products and services provided by Carlton Whatley.

Requirements for Use of Products and Services.
Products and Services provided by Carlton Whatley are designed and intended to be used by business owners and general consumers. You represent and warrant that you willingly enter into this agreement with Carlton Whatley. You also represent and warrant that you: have the legal capacity, are under no duress, and are not being influenced by any mental or physical condition.

Product and Service Offerings
Carlton Whatley offers and provides products and services related to the practice of personal computer consulting as it pertains to computer systems utilizing Windows operating systems. This includes but is not limited to: (1) OEM and non OEM hardware installation (2) technical support and recommendations (3) network administration, installation and technical support (4) needs analysis and computer system design (5) internet and e-mail setup and support (6) the removal of virus, spyware, adware & malware entities - and the installation and maintenance of software to prevent infestation (7) the implementation and ongoing support of the PC & Network Maintenance Assessment Agreement (8) and generally providing any product, service and or recommendation pertaining to the field of personal computers and networking that is mutually agreed upon by Carlton Whatley and you. This overall listing of various products and services shall herein be referred to as "consulting" or "consultation". Consultation is offered and provided on an on-call and scheduled basis.

On-call consultation is instituted by you, by placing a telephone call or writing an e-mail to Carlton Whatley and requesting assistance. Carlton Whatley will respond by telephone or e-mail as soon as is possible - if it is mutually agreed upon that a need for service is necessary, an appointment will be setup for Carlton Whatley to provide consulting services to remedy your defined problem(s) - and possibly other problems that you may not be aware of at the time. Consulting services may be provided on-site, remotely, via e-mail or by telephone depending on the problem at hand. Any estimates given for time necessary to complete tasks are only estimates and are made in good faith but are not to be adhered to. In order to provide "remote" consulting services, it is required that remote control software be installed and maintained on your computer system(s).

Fees and Payments
Carlton Whatley offers and provides computer consultation in exchange for monetary compensation. The amount of the Fees charged for providing consultation is outlined on the "Services and Fees" page of this website. Fees are subject to change. If fee changes are made, you will be notified by e-mail before the changes are implemented. After consulting services have been provided, you will be notified with an invoice that gives detailed information in a line-item fashion as to what consulting services have been provided and their associated fees. Invoices are delivered as an attachment to an e-mail as a PDF file type whenever possible. You will need software capable of reading PDF files in order to view the invoices. Payment for provided consultation services is due upon receipt of the invoice and is payable by connecting to www.carltonwhatley.com - and clicking on the "Make a Payment" link. We will only accept personal or company checks in the event that the customer does not have the necessary means to pay with a debit or credit card.
